Rules for accounts, race reports, reviews and clubs on OCR Guide, including rights to your content and community standards.

These terms of use govern the use of OCR Guide, in particular accounts, race reports, reviews, clubs and comments. The operator is Upscaled Media GmbH, details are set out in our imprint.

Account and minimum age

You can submit race reports and reviews without an account. Clubs and further features will require an account in future. Registration is permitted from a minimum age of 16. Community rules

We treat each other with respect on OCR Guide. In particular, the following is not permitted: abusive, discriminatory or unlawful content, spam and advertising unrelated to the topic, spreading false factual claims about races or people, and content that infringes the rights of third parties.

User content

When you submit race reports, reviews, comments, photos or videos, you keep the copyright in your content. You grant Upscaled Media GmbH a simple, royalty-free licence without territorial restriction. It covers

  • publishing the content on OCR Guide and showing it as part of the platform’s functions,
  • showing it on OCR Guide’s social media channels (such as Instagram, Facebook, TikTok, YouTube) and in the OCR Guide newsletter, each time crediting OCR Guide as the source,
  • adapting it technically for these purposes, i.e. resizing, cropping, compressing, adding a title and shortening videos, without distorting their meaning.

You do not grant us a right to sell your content or to pass it on to third parties for their own purposes. When publishing, we credit the name you entered in the form, or publish anonymously if you chose that. Your email address is never published.

Photos, videos and third-party rights

By submitting photos or videos you confirm that you took them yourself or hold all rights required, that people who are clearly the focus of a shot, for example in portraits or close-ups, agree to publication, and that no third-party rights are infringed, such as personality rights or copyright. Consent is not needed for shots showing what happens at an event, such as the field of competitors, the start, obstacles or the crowd, nor for people who only appear incidentally next to a landscape or location (Section 23 of the German Art Copyright Act, KUG). This exception does not apply where legitimate interests of the person shown are harmed, for example in embarrassing or intimate situations, or for children clearly in the foreground. If a claim is made against us because your content infringes rights, you indemnify us to the extent that you are responsible for the infringement. Photos of race courses or events must not show organisers’ copyrighted branding or course materials in a way that infringes their rights.

Moderation

Race reports, reviews and comments are reviewed by our editorial team before they become publicly visible. We reserve the right to reject, shorten or later remove content that breaches these terms or applicable law.

Deletion

You can have your content deleted at any time via our contact page or by replying to our confirmation email. We then remove it from OCR Guide and the licence ends for the future. On request we also delete social media posts already published, as far as the platform allows. We have no control over shares by other users of that platform.

Liability

We are liable under statutory rules for intent and gross negligence. We give no guarantee as to the accuracy or completeness of content published by users, for example course descriptions, difficulty ratings or gear tips in race reports. Always check safety-relevant information directly on the organiser’s official page.

Changes to these terms

We may change these terms, for example as new features such as affiliate links or clubs develop further. We will inform registered members of material changes in a suitable way.

Applicable law

The law of the Federal Republic of Germany applies.
